Chicago Citation: Public Urination (8-4-081)

Public Urination or Defecation in violation of Chicago Codified Ordinance 8-4-081 is an ordinance violation punishable by a fine or jail time.  In the City of Chicago, the most common place to get cited for public urination is Wrigleyville. Most people charged with this offense are concerned about the conviction showing up on a criminal background check and/or appearing in court.

First, private companies perform criminal background checks and the software is just getting better and more inclusive.  Further, as more public records become available online it is also possible that this information could be reachable via the web.  Therefore, this may or may not show up on a criminal background check now, but it most likely will appear in the future.

Second, an individual charged with Public Urination or Defecation has the option to plead guilty and pay the fine online.  A person can also hire an attorney to appear on their behalf and negotiate a resolution in the case.  A resolution could range from dismissal of the charge to a plea agreement to lesser charge involving a fine or community service.

(a) No person shall urinate or defecate on the public way, or on any outdoor public property, or on any outdoor private property.  Except as otherwise provided in subsection (b), any person who violates this section shall be fined not less than $100.00 nor more than $500.00, or shall be punished by imprisonment for not less than five days nor more than ten days or by both such fine and imprisonment.

(b) Any person who violates this section while within 800 feet of a parade route which is not open to traffic shall be fined not less than $500.00 nor more than $1,000.00 or shall be punished by imprisonment for not less than five days nor more than ten days or by both such fine and imprisonment.  For purposes of this section, the term “parade” has the meaning ascribed to the term in Section 10-8-330 of this Code.

(c) This ordinance shall not apply to use of a temporary or permanent structure or enclosure erected outdoors for use as a toilet facility.
