STATUTE
Excessive Speeding is a crime in Illinois. 625 ILCS 5/11-601.5 entitled Driving 26 miles per hour or more in excess of applicable limit, provides:
- A person who drives a vehicle upon any highway of this State at speed that is 26 miles per hour or more but less than 35 miles per hour speed limit established under this Chapter or local ordinance commits a Class B misdemeanor.
- A person who drives a vehicle upon any highway of this State at speed that is 35 miles per hour or more in excess of the speed limit established under this Chapter or local ordinance commits a Class A misdemeanor.
PENALTIES
As stated, the penalties are either a Class B Misdemeanor or Class A Misdemeanor. Generally, a Class B Misdemeanor is punishable by up to 180 days in jail and a $1,500 fine. Similarly, a Class A Misdemeanor is punishable by up to 364 days in jail and a $2,500 fine. Effective January 2, 2015, a person charged with either a Class A or Class B Misdemeanor Speed may be eligible for court supervision.
CRAFTING A DEFENSE
No criminal case is the same, but all cases are defensible in Illinois. The prosecution faces the challenge of having to prove each and every element of the speeding offense. The ticketing or arresting officer will be required to testify. If we proceed to trial, we will challenge the officer’s memory, credibility, and possible defenses.
